Webinar: Environmental Clearance Mandates for Multifamily Housing

This webinar will include an overview of requirements and common Issues that can impact your timeline as well as, updates and more stringent guidelines as noted in the recent HUD training. These include the following issues which could delay environmental clearance for 30 days or more impacting your ability to close on land or meet Tax Credit or HOME deadlines.

  • Lack of approval from the Texas Historic Commission
  • Inadequate or no review of Tribes as prescribed utilizing HUD’s online tribal database
  • Lack of required 8-step process as required by HUD for properties in the 100-year floodplain
  • Inadequate endangered species review, must have review by US Fish and Wildlife
  • Review by EPA for properties constructing in areas identified on the Sole Source Aquifer Maps
  • Phase I ESA does not include the required Vapor Screening (Transaction Screen not Acceptable)

Purpose of the Session:

  • How does the Environmental Review Process impact the timing of a Multifamily Housing Development?
    • If not timed properly, the Environmental process will delay the ability to close on loans, acquire property, (including between development partners) and begin construction of ANY portion of the project.
  • Learn the risks, to the developer or any of their partners, if they close on a deal, acquire land, or begin construction on any portion of the project, regardless of funding source, prior to environmental clearance.
  • Understand how locating in a Special Flood Hazard Area will affect a development.
  • Learn how noise affects environmental clearance.
  • Learn the difference between a Phase I ESA and the HUD Part 58 Environmental Review.
  • Learn you must include a vapor encroachment screening, per ASTM E2600 - 10, as part of Phase I clearance.
  • Learn the importance of Timelines and Format; Recognize and use the New Required Format and checklists - submissions not following these instructions will be rejected.
  • Understand the revised and new regulations that contract awardees must meet to receive Environmental Clearance, including Tribal Review and clarified requirements for Endangered Species protection.
