10/13/2023 In compliance with §2001.023, Texas Government Code, a summary of the proposed rule follows:§2306.359 of the Texas Government Code requires the Department to provide for specific scoring criteria and underwriting considerations for its multifamily private activity bond activities. The Department developed the Multifamily Housing Revenue Bond Rules to establish the procedures and requirements relating to the issuance of bonds. These rules speak to the threshold requirements of a pre-application and include the scoring items by which a pre-application is evaluated. These rules provide general requirements relating to the full application process where the Department is the bond issuer.

The Texas Department of Housing and Community Affairs (TDHCA) staff will host an online Q&A session regarding the implementation of the Housing Opportunity Through Modernization Act of 2016 (HOTMA) on December 6, 2023. The session will begin at 9 a.m. and last until approximately noon, Central Time. The Q&A session can be beneficial to TDHCA's housing partners operating in any of the multifamily (HOME, TCAP-RF, HOME-ARP, NHTF, NSP, HTC, BOND, Exchange, TCAP and THTF) programs and Section 811. There will be no presentation to go with this session. TDHCA's Compliance Division presented a training regarding HOTMA on September 8, 2023, and a follow-up webinar on October 13. It would be helpful for anyone wishing to ask questions during the offered Q&A session to have watched the previously offered webinars related to HOTMA. The requirements of HOTMA go into effect on January 1, 2024. All certifications with an effective date in 2024 must follow the HOTMA changes. The HOTMA rule was officially published in the Federal Register on February 14, 2023. TDHCA has until January 1, 2024, to implement the broader income and asset changes in Sections 102 and 104.
