Remedial Plan (PDF) - The Department has filed a copy of this document with the court in the litigation styled Inclusive Communities Project, Inc. vs. Texas Department of Housing and Community Affairs et al. This matter is currently pending in federal court in Dallas. Because this is the subject of pending litigation the Department is not commenting.

Memorandum Opinion and Order (PDF) and Judgment (PDF) entered by the federal court in Dallas in the litigation styled Inclusive Communities Project, Inc. vs. Texas Department of Housing and Community Affairs et al. on August 7, 2012. These refer to and are generally consistent with the Remedial Plan above previously filed by the Department.

TDHCA on Tuesday, September 4, 2012, filed with the court a motion (PDF) specifically requesting clarification regarding, among other concerns,applications that are part of a revitalization effort and regarding the Remedial Plan’s impact on 4% tax credits.

Memorandum and Order (PDF) and Amended Judgment (PDF) were released November 8, 2012, with respect to the motion above previously filed by the Department. Pending further direction from the court, the Department will not comment on the status of these proceedings.
