Retail Monitoring

At least twice annually, the MHD will visit each retailer licensed with the Department and review customer files to ensure that all required documentation is maintained. Additionally, the MHD inspectors will confirm during:

  1. Confirmation that license is displayed.
  2. Confirmation that each salesperson sponsored by that retailer is displayed.
  3. Confirmation that the Consumer Protection Notice is displayed.
  4. Confirmation that the company’s website contains a link to the MHD’s website.

Effective 9/28/2011, the MHD will also confirm that each Retail location has an onsite management official who has completed the Department’s initial education requirements (only required if the Retailer’s license was originated after September 28, 2011), pursuant to SB 1, 82nd Legislative session.
